Brendan Bernicker

Visiting Assistant Professor of Law

Brendan Bernicker is a Visiting Assistant Professor at Penn State Law. His research focuses on constitutional law and artificial intelligence. Prior to joining the law faculty, Professor Bernicker had a solo legal practice advising startups and small businesses on a range of matters, including incorporation, mergers & acquisitions, trademark registration, and data privacy. He also advised individuals, including professional athletes in the United States and England, on immigration, estate planning, and tax matters. Before that, he was a Resnik-Curtis Liman Fellow in the Supreme Court & Appellate Program at the MacArthur Justice Center.

Professor Bernicker has represented people in civil, criminal, and administrative proceedings at every level, from trials in county courts to appeals in the Supreme Court of the United States. He also develops software to help law firms and legal nonprofits work more efficiently. Professor Bernicker is licensed to practice law in Pennsylvania and the District of Columbia, as well as before several federal courts. He is also an enrolled Solicitor of the Senior Courts of England and Wales, though he does not hold a current practicing certificate as a solicitor.
